General Terms and Conditions for Use and for the Purchase – Sale of Goods via the E-Commerce Website

These General Terms and Conditions (“Terms”) govern the relationship between:

“Venati Studio” EOOD, registered in Sofia, UIC: BG203831009, with its registered office and management address at 5 Rosen Street, Sofia (hereinafter referred to as the “Supplier”), on the one hand,
and on the other – the individual who agrees to these “Terms” (hereinafter referred to as the “Customer”), in connection with the ordering and purchase of the goods offered through the online store at https://beemybloom.com/.

Please review these General Terms and Conditions for using the online store https://beemybloom.com/. These Terms govern the relationship between the Supplier and the Customers who use the online store to purchase goods. By clicking on an object, image, link (other than the one for these Terms), or button located on the website https://beemybloom.com/, you are deemed to accept and agree to the following Terms. These Terms comply with the requirements of the Consumer Protection Act and other applicable regulations in the Republic of Bulgaria. If you do not agree with these Terms, please do not continue to use https://beemybloom.com/.

Definitions and Terms

1.1 For the purposes of these Terms, the following definitions shall apply:

• “Supplier” means Venati Studio EOOD, owner of the website https://beemybloom.com/, which serves as a virtual platform for the sale of goods. The Supplier reserves the right to unilaterally modify the content of the website, as well as the methods of access thereto.
• “Customer” is a legally competent person who has agreed to these Terms in connection with ordering and purchasing the goods offered in the online store.
• “Online Store” is the website https://beemybloom.com/, which serves as a virtual platform for offering goods for remote purchase, to be delivered upon explicit order by the Customer.
• “IP Address” is the unique identification number assigned to a computer, webpage, or resource of the Customer, allowing its location to be identified on the global Internet network.
• “User Profile” is a section of the website that contains the Customer’s information. This data is provided by the Customer during registration and is stored by https://beemybloom.com/. Access to the User Profile is granted via a username and password. Within their profile, the Customer may view and edit the data provided during registration, access information regarding all their orders from the e-commerce store, change their access password, etc.
• “Password” is a combination of characters (letters and/or numbers) chosen by the Customer that, together with the Customer’s current email address, uniquely identifies the Customer and allows them to place valid orders for the goods offered on https://beemybloom.com/.
• “Order” is the request made by the Customer to the online store for the purchase of one or more specific goods (items). The order is packaged and dispatched by courier to the address specified by the Customer.
• “Selling Price” is the final price for a unit or a specified quantity of a good or service, including the value added tax and any additional taxes and fees.
• “Courier” is the service provider that physically delivers the purchased good to the address provided by the Customer, operating in accordance with the Postal Services Act.
• “Force Majeure” is an unforeseen, extraordinary circumstance occurring at the time of order submission that makes its execution objectively impossible.

Terms of Use of the Online Store

2.1. Access to the online store https://beemybloom.com/ is completely free and available from any location in the world.

2.2. https://beemybloom.com/ is an e-commerce website where goods are offered for purchase by end users. The information published on the site is for personal, non-commercial use only. The content of the website may not be altered, copied, distributed, transferred, or manipulated in any other way.

2.3. To shop from the online store https://beemybloom.com/, registration with a password and email address is required. Registration is completely free and is completed by filling in the registration form. During registration, the Customer must provide an email, password, full name, and delivery addresses.

2.4. Customer Data – including full name, region, city, postal code, delivery address, correspondence address, contact telephone, and current email – provided voluntarily by Customers during registration on https://beemybloom.com/ are protected by the Personal Data Protection Act. These data are collected solely to be forwarded to the courier for delivery of the selected good.

2.5. The Supplier does not sell, rent, lease, trade, or otherwise disclose any personal information collected on https://beemybloom.com/, including membership data or mailing lists. Any information provided on https://beemybloom.com/ will be securely stored and will not be used in any manner not consented to by the Customer.

2.6. The Supplier publishes on https://beemybloom.com/:

• 2.6.1. A description of the main features and an image for each good;
• 2.6.2. The selling price, key characteristics of the good, and additional information to assist in making an informed purchasing decision. Additionally, each product page allows Customers to post reviews and ratings concerning the good, as well as information on payment methods, delivery, and order fulfillment. All prices on the website include VAT.
• 2.6.3. Information regarding delivery charges, which are not included in the selling price, is provided upon completion of the order and in the “Delivery and Payment” section.
• 2.6.4. The Customer’s right and the conditions and manner in which they may withdraw from an order, and the conditions under which a good may be returned, except in cases provided by the Consumer Protection Act;
• 2.6.5. Any other information that the Supplier is required to timely provide to the Customer in accordance with Bulgarian legislation prior to the purchase of a good.

2.7. The Supplier reserves the right to change prices, quantities, payment and delivery methods, as well as the design and technology of the website. The Supplier also reserves the right to remove or delete information regarding any product or category at its discretion. Customers are advised to independently monitor https://beemybloom.com/ for such changes. In the event that a change affects an already placed order—such as changes in price, product, or delivery time—a representative of the Supplier will contact the Customer to inform them of the change and to determine whether the Customer wishes to proceed with the purchase under the new conditions.

2.8. The Supplier may place electronic links to other websites and resources for the sale of goods and provision of services by third parties, including links placed in the Customer’s profile.

2.9. The Customer undertakes to:

• 2.9.1. Provide accurate and valid telephone number, delivery address, and email address for correspondence;
• 2.9.2. Pay the price of the goods they have ordered;
• 2.9.3. Pay the delivery charges, except in cases where the delivery costs are borne by the Supplier;
• 2.9.4. Take all necessary precautions and measures to safeguard their password;
• 2.9.5. Due to the nature of Internet protocols and data security, log out of their User Profile by clicking the “Logout” button when finished;
• 2.9.6. Not submit fictitious or invalid orders or other incorrect information. The Customer is fully responsible for safeguarding their password and for all actions taken using it by themselves or a third party.
• 2.9.7. Adhere to the procedures and conditions for submitting claims and requests for replacement of ordered goods as published on https://beemybloom.com/, thereby agreeing to be bound by these rules and conditions;
• 2.9.8. Comply with Bulgarian legislation, these Terms, Internet etiquette, and the principles of morality and decency;
• 2.9.9. Not infringe on any proprietary or non-proprietary rights, including intellectual property rights;
• 2.9.10. Not interfere with the proper functioning of the system, including, but not limited to, not circumventing the identification procedure of another Customer, not accessing resources beyond those provided, and not hindering other Customers from using the store;
• 2.9.11. Not extract, by technical means or otherwise, information resources or parts thereof from the databases available on the store, thereby creating their own database in electronic or any other form.

2.10. The Customer is entitled to:

• 2.10.1. Online access to the Supplier, subject to compliance with access conditions and requirements, except in cases beyond the Supplier’s control—such as force majeure, unforeseen events, or global Internet issues;
• 2.10.2. Online access and correction of the data provided during registration;
• 2.10.3. Refuse to accept the ordered good, in accordance with legal requirements (Consumer Protection Act) and these Terms.

2.11. In the event the Customer fails to fulfill their obligations, the Supplier reserves the right, without prior notice, to immediately suspend the Customer’s and any third party’s access to their User Profile, as well as to claim compensation for all damages and lost profits directly resulting from such non-compliance. In these cases, the Supplier also reserves the right to involve the competent state authorities to address the violation.

III. Registration

3.1. In order to gain the right to place valid orders for the goods offered on https://beemybloom.com/, the Customer must provide the required and accurate data. The Customer guarantees that the data provided during registration is true, complete, and accurate, and will update it promptly if any changes occur. Should the Customer provide incorrect data, the Supplier reserves the right to immediately suspend access to the Customer’s profile without notice. The Customer may freely correct the information entered in the registration form.

3.2. By registering, the Customer provides online consent to these Terms and is thereby deemed bound by them. From the moment the Customer is bound by these Terms, they may place valid orders for the goods offered on https://beemybloom.com/.

IV. Placing Orders

4.1. The Customer gains access to the order form for purchasing the offered goods after entering a valid email address and password in the designated fields on the website.

4.2. The order is placed by performing the following steps sequentially: selecting the type of good and confirming the selection by clicking the “Add to Cart” button adjacent to the product, specifying the quantity, confirming the delivery address, choosing the payment method, and finalizing the order by clicking the “Place Order” button.

4.3. In the event that the ordered good (specific model) is out of stock, a representative of the Supplier will notify the Customer. If the Customer does not agree to substitute the order for another similar model or to have it specially produced, the order may be canceled.

4.5. Orders placed through the online store https://beemybloom.com/ are accepted 24 hours a day, 7 days a week.

4.6. Once the order is processed by the Supplier’s team, a confirmation is sent to the Customer. The order is then fulfilled and delivered to the Customer within 3 business days from the date of confirmation.

4.7. Orders submitted with incorrect or missing Customer data will be canceled if the Supplier does not receive the correct information within 48 hours of order placement. In the event of an incomplete, incorrect, or erroneous address and/or telephone number provided during order submission, the order is deemed invalid, and the Supplier is not obligated to fulfill it.

V. Delivery and Payment

5.1. Upon receiving an order from a Customer, the online store’s automated system notifies the Customer via email of the successful order placement.

5.2. Delivery is only carried out for confirmed orders. Delivery is made within up to 3 business days from the date of order confirmation, unless the Customer is personally notified of a different timeframe by a company representative.

5.3. Delivery of the ordered goods is not performed on Sundays or public holidays. Delivery timeframes are detailed in the “Delivery and Payment” section on https://beemybloom.com/.

5.4. The Supplier uses the courier companies EKONT or SPIDI for deliveries, with usual delivery hours from 9:00 to 17:30.

5.5. The purchased good is delivered in appropriate packaging and transportation mode, to the delivery address specified by the Customer.

5.6. Delivery is made to the exact address provided by the Customer (whether residential or business) or to an EKONT or SPIDI office in the corresponding city.

5.7. If the Customer does not provide access or the conditions necessary for the delivery at the specified address within the allotted time—or fails to collect the good from the designated EKONT/SPIDI office—the Supplier is released from the obligation to complete the delivery. The Customer may confirm their wish to receive the good after the delivery timeframe has expired, assuming all delivery costs, in which case a new delivery timeframe commences from the time of confirmation.

5.8. Payment for the ordered good must be made at the price listed in the online store at the time the order is placed. The price of each good may be changed at the Supplier’s discretion.

5.9. All prices are in Bulgarian Lev (BGN) and include VAT. The listed prices for individual goods are per unit and do not include delivery charges.

5.10. The Customer is obligated to pay the selling price of the purchased good, as well as any postal, courier, or transportation costs not included in this price that are related to its delivery.

VII. Copyright

7.1. All information published on https://beemybloom.com/, including product images and descriptions, is the property of the Supplier.

7.2. Copying texts from https://beemybloom.com/ and posting them on other websites or online stores without the Supplier’s written consent is prohibited, unless the source is quoted with the following text: “Source: online store https://beemybloom.com/”, and the following link is provided: https://beemybloom.com/.

VIII. Liability

8.1. The Supplier shall not be held liable to any third parties if any person considers that the information published on the online store violates copyright or other intellectual property rights, insofar as the product images published on the site have been created by the Supplier, with the photographic material commissioned by the Supplier.

8.2. The Supplier shall not be held liable for any interruption of access to the store, or for failure or delay in processing purchase orders in the event of circumstances beyond its control—such as force majeure, unforeseen events, or global Internet issues.

8.3. The Supplier does not guarantee uninterrupted, timely, secure, and error-free access to the store, as this is beyond its capacity, control, and will.

8.4. The Supplier is not liable for any damages to software, hardware, or telecommunications equipment, or for any data loss resulting from materials or resources searched for, loaded, or used in any manner through the store.

8.5. As the Supplier neither has the objective ability nor the obligation to control the manner in which Customers use linked websites and resources available via hyperlinks in the store or in the User Profile, the Supplier is not responsible for any unlawful content or materials found on those sites or resources.

8.6. The Supplier shall not be liable for any damages or lost profits resulting from the use, access, or inaccuracy of these materials and content.

8.7. Under no circumstances shall the Supplier, its suppliers, or third parties be liable for any damages, loss of information, lost profits, or other consequences arising from the use or non-use of the website, regardless of whether any warnings were provided. If the use of any materials from the website causes damages that require repair, service, or correction of equipment or data, the Customer shall bear full responsibility and all associated costs.

8.8. The Supplier is not obligated, nor does it have the objective capacity, to control how the Customer uses the store.

IX. Feedback

9.1. Every Customer may contact the Supplier for questions, suggestions, or further information. Contact may be made via the email address provided on the website or by calling +359 88 77 96 059.

9.2. The Supplier is the administrator of the website and the discussion/comment sections. In performing this role, the Supplier may remove any offensive or indecent remarks that violate morality or decency.

X. General Provisions

10.1. The Customer may request the deletion of their account at any time. In such a case, deletion will only occur after all validly submitted orders have been processed and the respective prices and delivery costs have been paid.

10.2. The Customer is obliged to indemnify the Supplier and any third parties for any damages or lost profits, including any expenses and legal fees incurred as a result of claims made by third parties due to the Customer’s non-fulfillment of obligations, breach of Bulgarian legislation, applicable foreign laws, these Terms, or standards of decency and Internet etiquette. The Customer is also obliged to indemnify the Supplier for any damages caused by third parties who have gained access to their account through the sharing of their password.

10.3. The parties declare that if any provision of these Terms is found to be invalid, this shall not render the entire Terms invalid; any invalid provisions shall be replaced in accordance with the mandatory provisions of law.

10.5. All disputes between the parties shall be resolved amicably. In the event that no agreement can be reached, any unresolved disputes arising from the relationship between the parties shall be submitted to the competent court in Sofia.

10.6. Compliance with the written form is deemed to be met by sending an email, clicking an electronic button on a page containing the Customer’s input, or marking a field on the Supplier’s website—provided that the statement is recorded in a technical manner that allows it to be reproduced.

10.7. These Terms may be unilaterally amended by the Supplier. Amendments to the Terms do not affect relationships between the Customer and the Supplier arising from valid orders placed prior to the notification of such changes. 10.8. For any issues not covered by these Terms, the provisions of the applicable legislation of the Republic of Bulgaria shall apply.
